Do I still have to make payments on the real estate while it’s in probate?

If the decedent had a reverse mortgage on the property it’s a little different type of situation.


Obviously they were receiving income and not paying the mortgage company, but once the decedent passes away the mortgage company will be notified and they’re going to be aware and the time-clock begins to tick at that point.


They give you 180 days from the date of death to be able to pay that loan back to them. Now, they do grant extensions of 90 days – two of those – so, in a sense, you have to demonstrate to them after 180 days that you’re working toward the goal of paying off that loan, and then if you need it you can get that other two extensions.
