Is there a difference between regular transactions and probate transactions?

Yes, there’s a big difference.


A standard transaction is completely different than a probate transaction. Obviously, in a probate transaction, we have court involvement; we have attorneys involved; we have the Administrator involved; and we need to make sure that we work within the guidelines that are set forth with regard to the court. Part of that is using the proper paperwork.


Probate transactions use completely different purchase agreements and completely different disclosure obligations. We need to make sure that all the paperwork is exactly what is required of the court so once we do get in front of a judge everything is done properly and there won’t be any problems or delays as a result of using incorrect paperwork.
