What is a Probate Referee?

A Probate Referee is a court appointed appraiser.


They will appraise the property and they generally get paid 1% of what they appraise the property at. We need to sell the property within 90% of whatever the court Probate Referee appraises the property for, so it’s really kind of a critical number – especially on a court confirmed sale. We have to be within that 90% or the judge will kick the sale out and we’ll have to begin the process over again.


It’s a really important number and once you’re appointed your attorney will request the Probate Referee to do the appraisal. It usually takes about 45 days for them to get out to do that.
